In these Terms and Conditions of Sale:

“Contract” means the contract for sale and purchase of Goods in accordance with these Terms;
"Seller" - means Società Agricola Terracalò S.r.l., also referred to as Terracalo.it;
"Customer" - means any private Customer;
"Goods" - means the products to be supplied by the Seller to the Customer;
"Website" - means www.terracalo.it;

The present Terms and Conditions of Sale govern the sale of products sold by Terracalo.it through the website www.terracalo.it.

These Terms and Conditions apply to and form part of every Contract made on the Website between Terracalo.it and the Customer (in accordance with the Italian law and in particular the Legislative Decree no. 70/2003 relating to electronic commerce and to the Legislative Decree no. 206/2005, with specific reference to the legislation in respect of remote contracts).

Any changes or new conditions of sale will be promptly reported to the Customer, will be effective when published on the Website and will be applied only to Contracts settled after the publication.
• Terms and conditions of Sale acceptance
The contract between the Seller and the Customer shall be concluded with the acceptance of the order by the Seller. The acceptance is automatic, unless otherwise communicated to the Customer.
By placing an order following the methods provided, the Customer declares that has read the information provided during the purchase procedure and accepted the conditions written below.
The Customer is therefore invited to read these Terms and Conditions of Sale carefully, print them or save them in another safe device.

• How to Buy
The Customer can only purchase Goods as described on the Website at the time the order was placed. The images on the Website are provided to the Customer to facilitate the recognition of Goods. The order confirmation is sent by the Seller via e-mail, to the email address supplied by the Customer. The confirmation message will display date and time of receipt of the order and an "Order Number" to be used in any further communication with the Seller, as well as a reference to the sale status.

In case of non-acceptance, the Seller will inform the Customer immediately.
All prices on the Website are for general retail and are inclusive of VAT. The Seller reserves the right to change prices on the Website at any time, without notice.

Customers outside Italy are responsible for the payment of any applicable VAT and duty (or their equivalent) in the country of delivery. These costs, which vary from country to country, are charged to the Customer, who has the burden of verifying the amount with the correct customs authorities. In response to a written request, we will refund the Customer of the costs incurred.
• Payment methods
Payment of Goods on the Website can be made by PayPal, as indicated in the purchasing process.

• Delivery methods
The Seller delivers its Goods through specialized couriers. The Seller, in general, pays the shipping costs.
Depending on the area of ​​destination of the Goods, deliveries may take place in a period of time ranging from 24 hours to four days, unless unexpected circumstances occurs (at the latest, Goods will be delivered within thirty days from the date of the order).
On receipt of Goods, the Customer is required to check their integrity, if in doubt about the integrity of the package, the Customer shall sign the delivery documents with discrepancies annotated as appropriate. The Customer will have 14 working days to verify the integrity of the Goods, and communicate any damage it in writing, via e-mail at customer@Terracalo.it .
The Seller will refund the Customer within 14 working days.

• Right of withdrawal
The Customer has the right to withdraw from a contract entered into with the Seller within 14 days following the day on which the Goods come into their physical possession without giving any reason. To exercise the right of withdrawal, the Customer must give written notice to the Seller by emailing  aziendagricola@terracalo.it. In the communication, the Customer must indicate the Goods for which they intends to exercise the right of withdrawal. A withdrawal notice FORM is available here.

Return fees are charged to the Customer.
If the Customer withdraws from a contract, the Seller shall reimburse to the Customer all payments received from it, including any costs of delivery, without undue delay and in any event not later than 14 days from the day on which it has collected the Goods or the Customer has supplied evidence of having sent back the Goods.
• Guarantees
The Seller warrants that the Goods delivered will correspond with any description given on the Website. All Goods sold fall under the producer responsibility. The producer is also responsible for the truthfulness and completeness of the information on the packaging.

• Privacy
Any personal data the Seller collects from the Customer during the submission of the order, will be processed by the Seller on electronically in order to meet the obligations of the settled contract with the Customer. Under no circumstances will the Seller share this information with any third party.
The Seller warrantees its Customer the respect of rules, concerning the processing of personal data, covered by the Privacy Code under LD. No 196 of 30.06.03.
The data controller is Terracalo.it S.r.l., Taranto, in the person of the legal representative, unless a manager is appointed under the Article. 29 of Legislative Decree no. n. 196/2003. The Customer, at all times, has the right to withdraw consent to the processing of personal data by giving written notice to the Seller at the above address. The Customer, in accordance with art. 7 of Legislative Decree. N. 196/2003, has the right to access their data in the manner specified therein. Marketing communications will be sent only with the explicit consent of the Customer.
Customer consent is requested and accepted during the online registration.
• Child protection
In Italy, it is illegal to sell alcohol to anyone under the age of 18 years. Similar restrictions apply in other jurisdictions. By placing an order with the Seller, the Customer confirms that he or she is at least 18 years old (or otherwise above any applicable age limit). At the time of delivery of the Customer's order, the Seller or its agent may request proof of age from the person accepting the delivery. If appropriate proof cannot be produced, the Seller or its agent may refuse to deliver the order.

• Complaints

• Governing Law and Jurisdiction
These Terms and Conditions and all contracts entered into are governed by Italian law and are subject to the exclusive jurisdiction of the Forum of Taranto.

In the event of a dispute about the contents or interpretation of these Terms and Conditions of Sales, the Italian language version shall apply, prevail, and be conclusive. The Italian version is available on the Website or shall be sent to the Customer upon written request.
